General terms and conditions

Article 1 – Definitions
In these general terms and conditions the following terms are understood to mean:

Reflection period : The period within which the consumer can make use of his right of withdrawal;

Consumer : The natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;

Duration transaction : A distance contract relating to a series of products or services, the supply and/or purchase obligation of which is spread over time;

Right of withdrawal : The option for the consumer to cancel the distance contract within the cooling-off period;

Entrepreneur : The natural or legal person who offers products or services remotely to consumers;

Distance contract : An agreement concluded between the consumer within the framework of a system organised by the entrepreneur for the distance sale of products and/or services, whereby up to and including the moment the agreement is concluded exclusive use is made of one or more techniques for distance communication;

CESOP : The Central Electronic System for Payment Information, introduced by the EU to control payment service providers.

Article 3 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded. Before the contract is concluded, the terms and conditions will be made available to the consumer electronically or otherwise.
Article 4 – The Offer
Offers are non-binding. The entrepreneur reserves the right to change offers.
The offer clearly states the total costs, including shipping costs, import duties and any additional charges levied by the postal or courier service.
Article 5 – The Agreement
The agreement is concluded when the consumer accepts the offer and meets the stated conditions. The entrepreneur confirms acceptance immediately by email.
Article 6 – Right of withdrawal
The consumer has the right to cancel the agreement without giving any reason within 14 days after receiving the product.
The costs for returning are borne by the consumer.
Article 7 – Costs upon Cancellation
The entrepreneur will refund any amounts already paid within 14 days of cancellation, provided the product has been returned in its original condition.
Article 8 – Customs and VAT regulations
The customer is responsible for complying with all legal obligations regarding the import of goods into the destination country, including import duties, taxes and customs clearance fees.
The entrepreneur does not act as an importer of the goods on behalf of the customer.
The customer is responsible for compliance with local laws and regulations regarding the import and use of purchased products.
Any additional costs incurred during customs clearance, including postal or courier administration fees, are the sole responsibility of the customer.
The company will provide the necessary documentation upon shipment, but cannot guarantee that the products meet local import requirements. Customers are advised to check import requirements in advance.
Article 9 – CESOP Compliance
From 2024, payment service providers will record transaction data in the CESOP system (Central Electronic System for Payment Information), as stipulated in EU legislation. Merchants must comply with this regulation, which may impact payment monitoring and reporting.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that the delivered products comply with the agreement and legal requirements.
Complaints about defects must be reported in writing within 14 days.
Products must be returned in their original condition and packaging.
Article 11 – Delivery
Orders will be delivered within 30 days unless otherwise agreed.
In case of delay, the consumer will be informed within 14 days after the order date.
Shipments are shipped under conditions where the customer as recipient is responsible for all import procedures.
The entrepreneur ensures correct shipping according to international regulations, but is not responsible for delays or problems at customs.
Failure by the customer to comply with import obligations does not entitle the customer to cancel or refund the order.
Article 12 – Complaints procedure
Complaints must be reported in writing within 7 days of discovery.
The entrepreneur will respond to complaints within 14 days. If a longer processing time is required, an indication of the timeframe will be provided.
Article 13 – Disputes
These terms and conditions are governed by Dutch law. Disputes will preferably be resolved amicably. If necessary, disputes will be submitted to the competent court in the Netherlands.
